    DEAR CLIENT:

    Our institution operates under the strict supervision of the Banking Superintendent of Panama (SBP) and under the Superintendent of Securities Markets (SMV), both of which are government authorities of the Republic of Panama. The principal regulations that we are subject
    to are as follows:

     

    A. BANKING AND TRUST MATTERS

    Our institution is subject to the terms established in Law Decree No.9 of February 26, 1998, modified by Law Decree No. 2 of February 22, 2008, and passed by Law Decree No. 52 of April 30, 2008.


    Regulation that is applicable to the trust sector is Law No. 1 of January 5, 1984, modified by Law No. 21 of May 10, 2017, which regulates Trusts in Panama as well as other guidelines.

    B. SECURITIES MATTERS

    The Brokerage House license held by Banco de Bogota (Panama), S.A., is regulated in accordance with what is established by Law Decree No. 1 of July 8, 1999, issued by the Panamanian government.     It is required by law to advise the client that the Banco de Bogota (Panama), S.A. Brokerage House is not the final custodian of the the financial assets given that it employs Global or Omnibus Accounts to trade client positions. Only the Bank´s third party client positions can be held in these types of accounts; in these accounts, trading the Bank’s own positions does not occur nor is it permitted.

     

    C. OTHER REGULATIONS

    Representation Office in Colombia:

    Banco de Bogota (Panama), S.A. has a Representation Office in Colombia which is duly authorized as per the terms of Article 4.1.1.1.7 of Decree 2555 of 2010. Therefore, its activities are limited to exclusively providing promotion and publicity for the financial products and services offered and provided by the Bank.

     

    Notice concerning deposits:

    Deposits established at Banco de Bogota (Panama) S.A. are not insured.

     

    Foreign Account Tax Compliance Act (FATCA):

    The Foreign Account Tax Compliance Act (FATCA) is a United States Law passed on March 18, 2010, which went into effect on July 1, 2014. The primary purpose of the law is to identify citizens and tax residents of the United States who have financial assets in the rest of the world. The FATCA guideline requires that global financial institutions located outside the United States, including Panamanian ones, must identify those clients who are U.S. Persons and annually provide pre-established information on these clients to local tax authorities, which will afterwards be delivered to the United States.

    Exchange of information for tax purposes:

    The Republic of Panama has signed international agreements and issued legislation for the purpose of cooperation and exchange of information for tax purposes. Because of this, Banco de Bogota (Panama), S.A. is legally obligated to report certain accountholder information to the General Income Office (DGI) of the Ministry of Economy and Finance (MEF) when their tax
    residency is not Panamanian. In accordance with Agreement 2-2019 of the Banking Superintendent of Panama, all clients sign a sworn affidavit that confirms that flows in and out of the banking institution comply with and will comply with fiscal obligations in their country or countries of tax residency.

     

    Hiring flexibility:

    Banco de Bogota (Panama), S.A., advises that the client is completely free to choose the insurance company, insurance broker, sales agent and/or insurance account executive that they prefer when subscribing to the policies required for holding credit transactions with our Banking institution. Inasmuch, we reiterate that the Bank does not charge any kind of extra fee or penalty for choosing any of the above.

     

    Protection of personal data:

    Banco de Bogota (Panama), S.A., is under the jurisdiction of Panamanian law, that is, Law No. 81 of March 26, 2019.

    Claims:

    The products and services promoted by the representatives in Colombia from Banco de Bogota (Panama) S.A are provided in Panama City, Republic of Panama. The Office of Representation should not include a Financial Consumer Advocate in Colombia. Any complaint or claim can be addressed to the following email: reclamos@bancodebogota.com.pa. Your complaint will be responded to by the bank in no more than 30 days.
